I don’t understand why Trump wants to get rid of birthright citizenship.
Imo this is one of the core values that make America so great. The fact that everyone born on American soil is American feels like a natural law. This makes America feel way more open and free.
But if even people born in America will not be considered American than what type of country are we talking about? One that’s locked up for the elite?
Is there any way we can protect our constitution?
Because they want slaves.
If you aren’t a citizen you have no constitutional rights (arguable and not really but…) which means you can get sent to a work camp. Which… maybe the outcome for a lot of this country if the claims of doing mass sweeps starting tomorrow are true.
And this also avoids the “false positive” problem. That random brown person they arrested who is actually a citizen? Well, five generations back her family wasn’t so all of that is retroactively repealed and please bring her to the camp commandant’s office for special education
Even removing the 14th amendment wouldn’t take away non-citizen rights. The Bill of Rights applies to all persons living or residing within the United States. Regardless of whether or not they’re citizens.

I believe what initiated this line of thinking were “illegal immigrants” giving birth in America and having their children now be considered American. They don’t want that to be an option. Going forward from that, I think a “bonus” for them is that they can institute a more rigorous test for citizenship, prodding at what your political beliefs might be and they’d get to do it to everyone, weeding out people from the population they deem undesired.

It won’t happen. It’s just a dumb thing to talk about because they have no substance to the administration. All of this was just about keeping him out of jail and losing his assets. They need 38 states to ratify any changes to the constitution. Not happening.
You don’t need to change the constitution if the Supreme Court is under your control.
SCOTUS cannot not affect constitutional law, and they can’t enact new laws. Their job is to interpret the law, and constitutional amendments are a basis of fact for that. For instance, they can’t call the 14th amendment “unconstitutional”, because it’s the actual constitution. Doing so would automatically invalidate other rulings and yadayadayada, but yeah, they can’t do that.

It’s a really old piece of paper. It relies on our three branches of government being willing to uphold the laws and principles written on it. If the three branches of government are no longer willing to uphold those principles, then the Constitution is effectively about as binding as a child’s bedtime story. And right now, our three branches of government are largely unwilling to uphold the Constitution and have already hand-waved away many important protections already.
If Trump says “We’re going to ignore the 14th amendment”, and Congress passes a law that says “We’re going to ignore the 14th amendment”, and SCOTUS says “We’re going to ignore the 14th amendment”, then the 14th amendment may as well not exist. They don’t have to repeal it. They can just ignore it.
If you don’t believe that our government can and will just wave away Constitutional amendments when they become inconvenient, then remember that we just re-elected a former President who should have been disqualified until SCOTUS chimed in and said another part of the 14th amendment was already unenforceable. What do you think is stopping them from just chiming in and striking down the rest of it?
You can say that the 14th amendment is a thing all you’d like. But unless you have some method of actually enforcing it, it doesn’t matter.
They can call violations of the constitution constitutional, and there’s nothing legally that can be done to stop them.
You’re making the mistake of thinking they’re going to play by the established rules, which is wrong. They’ve already ruled that the president is a king.
You’re correct on the way things should work, but when the system is corrupt and broken, can one say “they can’t do that”? Resting on the very notion that everyone is following the same rules? Too many things have happened both lately and in the past that many dismissed before as, yeah, that won’t happen.
Just saying that while it would be wrong and illogical to declare something in the Constitution as unconstitutional, do not let them out of your sight for a second.

So… a prerequisite for being POTUS is birthright citizenship isn’t it? That’s what the birthers claimed made Obama an illegitimate president. If the 14th amendment is removed, I’m assuming that being the POTUS would just require U.S. Citizenship after that?
I might be way off. But I feel like this is something that could be done in the name of fighting illegal immigration in order to get people onboard, while also quietly opening the door for Musk to drive from the front seat in the future.

This is not as universal a thing as we think it is in America. Birthright citizenship is only common in North and South America, partly due to their colonial heritage. They needed more citizens to be successful countries after independence (and also to displace the native population). In Asia/Africa it is far less common. Sone European countries require that one parent at least has a residency permit before they automatically confer citizenship to children.
