No kidding your honor. The question is what exactly are you or any other judge going to do about it?

I don’t mean that in a Trump is right kind of way. I mean it in a this is something the judiciary needs to be seriously looking into sooner rather than later.

That’s what the article states. She’s mandating two weeks of intense discovery, which will lead to contempt of court if they cannot prove they have done everything in their power to return him.

Honest question: if the administration’s defense is shrugging because he’s in another country, doesn’t the judge have an easy layup to shut down CECOT deportations?

They can’t have it both ways, either follow due process or keep your slave detention camps domestic. It’s not interfering in foreign policy to point out they need to choose.

She did, with an injunction that they are continuing to defy. That’s another contempt of court charge. She has to do this slowly and methodically to prevent giving them evidence of bias when they appeal her rulings. The downside to a just court is the pace. Had we a functional Congress that wasn’t packed with loyalists, this would’ve been over by now.

How can they be found in contempt when they were never out of contempt.

They don’t care what judges say. The judges are just NOW finding that out?

In the legal system, far more things get reversed due to procedural issues than on merit. Generally, this is a good thing. A judge should not be able to hand out punishment on a whim.

As with most protections, fascists destroy the ones that limit them and cling to those that benefit them.

Wake up. Your courts haven’t been able to help you long before the cheeto was in power and was flaunting his many felonies. The courts literally gave him unlimited power already. There have been zero repercussions for him his entire life while you all cheered him on and brought him to power not once but twice.

This whole case has collapsed into a handful of choices:

    1. Judge doesn’t declare the Trump admin in Contempt of Court (i.e. does nothing). This sets precedent that Trump’s administration enjoys full immunity from the judiciary, officially turning the US into a dictatorship. This is what has been happening for weeks and remains by far the most likely scenario.
    2. Judge declares Trump in Contempt of Court, but is unable to enforce it. This is equivalent to scenario 1.
    3. Judge declares the Trump admin in Contempt of Court and deputizes state police to enforce the ruling and arrest, if not Trump, at least some officials. This would be legal and remains the only constitutional solution, but would almost certainly trigger an armed response from the regime. Democracy doesn’t go down without a fight, but the end result is uncertain.
    4. Pro-democracy factions use illegal/violent means to force Trump to comply (military coup, sudden Luigi’s Mansion remake, etc.). However it would seem that the masks fell off and despite decades of propaganda to the contrary, literally not a single living American is willing to put their life on the line to protect Democracy.

The administration will just apply for an appeal to the decision - 6 months - then if it is approved it goes to a one man Supreme Court ruling (18 months), then they appeal again (12 months) and it goes to the full bench (24 months) who will declare its now outside the scope of action.

There’s a serious chance they’ll have the guy killed to get the judge off their back without having to be seen backing down, and to show judges what happens when they try to challenge the regime on a deportation case.

Because they made the poor and uneducated afraid. That’s why all the guns. Fear of that which they do not understand. They were fed endless propaganda about how Trump cares for the working class. Republican Corporate media let them keep their guns as long as they had an enemy to point them at that wasn’t them. Keep them scared and afraid of their allies, their fellow working class.

Give them two weeks to do something. We’ll see, then what if they don’t provide? Another 2 weeks? They will just say he is dead or died in transit and it’s out of their hands. Then what happens? Let me guess.

    Fucking nothing.

In sane times, yes. But US Marshals are a part of the Dept of Justice, which answers to the Executive. So I’ll let you guess how that would play out if they were ordered to arrest Trump or anyone else in his circle.
